1. Under no circumstances will this cat be sold, leased, or given to any pet shop, research laboratory or similar facility.
2. Adequate indoor sanitary facilities will be provided and this cat will not be allowed to roam outdoors.
3. If this cat is found to be neglected or ill in health for an unreasonable length of time, purchaser will
surrender said cat to the seller unconditionally.
4. This cat will be immunized annually, as well as kept free of parasites.

6. Purchaser agrees that this kitten/cat, IF sold as a BREEDER, will be kept and bred solely by Purchaser
and ownership nor breeding rights shall not be transferred to another party/cattery without prior written and notarized
consent of Seller.  *Seller also suggests that kitten/cat should not be bred prior to 1 year of age; and should be
retired no later than the age of 5 years old (if cat is a female especially); as health conditions and problems
may arise from breeding too young or too old; and buyer agrees that the seller cannot be responsible for fertility problems; pregnancy problems; erectile problems; nursing problems; birth related problems or weaning
problems associated with this cat/kitten now; nor at any time in the life expectancy of said cat or involving cat's future offspring.
7. If purchased as a pet, this kitten will be neutered/spayed before going with the buyer to his/her new home, or by the purchaser by the time the kitten reached 6 months of age. If cat is not neutered/spayed by the age of 6 months, buyer agrees to pay seller
an additional sum of $_________________This does not mean breeding rights will be given.

Seller agrees to provide T.I.C.A registration papers for this cat or kitten as soon as they are received from T.I.C.A. by the seller and the buyer has fulfilled the spay/neuter agreement and buyer receives spay/ neuter certificate on said cat from the buyer, if kitten is purchased as a pet.   Yes_______No_______

10. Seller cannot guarantee any show wins on this cat. Seller cannot guarantee the quality or quantity of kittens this cat produces.
11. This cat/kitten is guaranteed against congenital defects for one year. Should it die within that time as a direct result of a congenital defect, the cat will be replaced ONLY if an appropriate autopsy is preformed by a licensed veterinarian and the vets certificate is provided as proof of cause of death. A replacement will be made with a cat/kitten of comparable quality and value, as available, at the discretion of the breeder. Due to the many factors involved in rearing and caring for this kitten that are beyond the control of the seller, there are no guarantees on the fertility or temperament. If this cat was purchased as a breeder and is found to be infertile, a statement must be provided by a licensed veterinarian saying so before a replacement is given. If a replacement is not available at the time, one will be given when available. There will be no cash refunds even if the breeder goes out of breeding.
12. The breeder has the right to ask for this cat to be returned before buyer receives a replacement. If the buyer refuses replacement the breeder will have no further obligation to the buyer. Buyer shall be liable to breeder for any and all legal fees incurred. It is the responsibility of the buyer to provide immediate veterinarian care to this cat if it shows signs of illness, distress or injury. Failure to provide veterinarian care will render the breeders contract guarantees null and void. Trauma, abuse or neglect of this cat will also void the breeder’s guarantees. If this cat has been exposed to another cat, that resident cat(s) must be free of parasites, fleas, ear mites and communicable diseases in order for this cat to be returned. We require a statement as to the health of the other cats in the household (and that they are fiv and felv negative) by the buyer’s veterinarian prior to returning this cat. Under no circumstances is the kitten to be destroyed prior to notification by the buyer to the seller.
13. Buyer has 72 hours to take this kitten to the vet to get a health check. . It is recommended that the new cat/kitten be in quarantine during this time, from any other resident animals. If the licensed veterinarian finds the cat to not be healthy due to a life threatening illness and possibly noncurable. He or she will provide a written statement explaining the findings and the kitten may be returned once the written letter is received and signed by a licensed veterinarian. Kitten will remain in quarantine until kitten is returned.
14. All veterinarian bills after leaving the seller, (shots, exams, etc.) are the responsibility of the buyer and shall be paid for by the buyer and not the seller.
15. It is further explained by the seller and understood by the buyer that felines (as any living creature) can contract and also potentially transmit many diseases/illnesses both present and also not present in/with other species of animals/pets/humans; it is the buyer's responsibility to educate themselves on various feline infections, diseases, parasites, symptoms, transmission sources, medications/remedies, and tests for those diseases and their prevention/vaccination/cure; including but NOT limited to :: Giardia,
Rabies, Panleukopenia/Distemper, Rhinotracheitis/feline Herpes virus/FHV-1, Calicivirus, Corona virus and the possibility of FIP infection, FeLV/ feline leukemia, FIV/ feline aids, Chlamydia, Ringworm, Toxoplasmosis, Campylobacter, Roundworms, Tapeworms, Mites, Fleas, Ticks, Lice, Bacterial Infections, Yeast Infections, Sinus Infections, Lymphomas of Vaccination sites, Scabies, Cheyletiella, Diabetes, Hepatic Lipidosis, Hypothyroidism, Hyperthyroidism, hypertrophic cardiomyopathy/HCM, FUS/Renal failure, renalstones, colitis or constipation, or even IBS causing Diarrhea, common colds, pneumonia, Mastitis, Blood type differences, varying causes for kitten mortality, regulation of body temperature, etc.
16. If this cat is a male, he is not to be used for stud service.
17. If this cat is purchased as a breeder, all future kittens produced from this Cat must be placed in pet homes only and not sold as breeders, they MUST BE NEUTERED/SPAYED/RENDERED STERILE BY THE BREEDER BEFORE ALLOWED TO LEAVE IT'S HOME ENVIRONMENT.
18. Seller has no control over the overall safety in the home or protection of the cat from falls/accidents, rough play which
may result in injury or death by children, adults or other pets in buyer'shome, health and exposure to diseases/illnesses, proximity to other animals or other cats with potentially life threatening diseases/conditions that could infect/harm this kitten/cat, feeding rations or quality of food,household hazards, chemicals,  poisonous plants, etc. that kitten/cat maybe exposed to once it leaves the custody and care of the seller's home environment into the hands/home of the buyer.
19. For Sphynx cats: Buyer agrees to provide weekly baths and ear cleanings along with daily eye cleaning (as required). These cats’ bodies produce oil, which dirt clings to. Failure to bathe and provide weekly ear cleanings may result in skin issues and even deadly ear infections. The above kitten/cat will leave this cattery freshly bathed with trimmed nails and freshly cleaned ears.
20. For sphynx cats: It is understood that degrees of hairlessness in sphynx vary from cat to cat and that no sphynx is completely hairless. It is understood that hormones, climate, and genetics play an important role in hairlessness and that even though a sphynx kitten may be almost hairless when sold, it is possible that the above kitten/cat could develop some hair after being neutered/ spayed or as it grows older. It is also impossible to guarantee that any sphinx kitten/cat will not grow some hair some hair at some point in the future.
21. Seller makes no guarantee as to the future temperament of this cat. Cats and small children should not be left alone unattended, as cats (as with any animal) and children can both be unpredictable.
22. I have read and agree with all the terms above. Buyer agrees if any legal action needs to be taken that all fees will be the buyer’s responsibility for both parties and it will be done in the state of North Carolina. If this contract is breeched in any way, buyer is to surrender this cat back to the seller without refund and at the buyer’s expense.
23. This contract is legally binding to all parties involved. It applies only to the buyer and the seller in this transaction and is nontransferable to other parties. The buyer agrees to the terms and conditions and to pay as stated.
